Terms & Conditions (AGB)
Plan-0 | Zero-Point-Publishing | Mentoring
Section 1 Scope and Provider
(1) These Terms & Conditions govern the contractual relationship between Sven Hardt (hereinafter "Provider")
and his customers for all services in the areas of Plan-0 / Zero-Point-Publishing and mentoring services.
(2) These Terms & Conditions apply to the websites plan-0.com, sven-hardt.de, zero-point-publishing.com,
impulsschmiede.eu, as well as to business communication via associated social media channels.
(3) For the purchase of books via Zero-Point-Publishing, Sections 2–4 of these Terms & Conditions additionally apply. For mentoring/coaching services, Sections 5 and 6 additionally apply.
Section 2 Description of Services
(1) Sale of books: Zero-Point-Publishing sells its own publications (including the "Hike for a Smile" series) in paperback, hardcover, and e-book formats directly to end customers, either via the order links embedded on the website or via brick-and-mortar and online booksellers.
(2) Zero-Point-Publishing (consulting): Support in the area of self-publishing, including advice on the creation and
marketing of works.
(3) Mentoring/coaching: Consulting as a resilience expert and mental coach. These services do not replace
medical or psychotherapeutic treatment.
Section 3 Ordering, Delivery, and Payment for Books
(1) By clicking the respective order link and completing payment via PayPal, the customer submits a binding offer to purchase the selected book format. The contract is concluded upon confirmation of payment by PayPal or upon shipment of the goods.
(2) Payment is made exclusively via the payment service provider PayPal.
(3) Shipping costs are determined by the shipping cost table published on projekt.html and are displayed before payment.
(4) Unless stated otherwise, delivery time is 3–10 business days within Germany, Austria, and Switzerland after receipt of payment. For limited special editions (e.g., hand-signed first edition), delivery time may be extended due to individual production.
(5) The e-book is provided as a digital download after receipt of payment, or via the respective distribution platform (e.g., Amazon Kindle, Tolino).
(6) Delivered goods remain the property of the Provider until paid in full (retention of title).
Section 4 Warranty
(1) The statutory warranty rights apply. For consumers, the warranty period for material defects is 2 years from receipt of the goods.
(2) Please report transport damage as promptly as possible; this does not affect the statutory warranty rights but helps in asserting claims against the shipping company.
(3) To assert warranty claims, an informal notice to the contact details listed in the Legal Notice is sufficient.
Section 5 Copyright and Usage Rights (Consulting/Mentoring Services)
(1) All content created in connection with consulting and mentoring services is protected by copyright.
(2) The customer receives a simple usage right for the agreed purpose. For self-publishing projects, the customer remains
the author of their own works, unless otherwise agreed.
(3) This provision does not apply to the purchase of books (Section 2(1)); here, the customer acquires a physical or digital copy for private use, without any usage or editing rights to the work itself.
Section 6 Limitation of Liability
(1) The Provider does not guarantee any specific economic outcomes (e.g., book sales figures) in connection with consulting/mentoring services.
(2) Liability is limited to intent and gross negligence.
(3) No liability is assumed for content on linked external websites.
Section 7 Right of Withdrawal
Consumers are generally entitled to a statutory right of withdrawal when purchasing books (Section 2(1)) as well as for mentoring/coaching services (Section 2(3)). The complete withdrawal instructions, including a sample withdrawal form and the applicable exceptions (including for personalized special editions with an individual dedication as well as digital content), can be found under Right of Withdrawal.
For digital services or mentoring that begins immediately, the right of withdrawal may expire early if the customer has expressly agreed to immediate performance.
Section 8 Final Provisions
The law of the Federal Republic of Germany applies. To the extent legally permissible, the place of jurisdiction is the Provider's place of business.
